1. Overview

These Terms of Service ("Terms") govern your access to and use of the BellyCozy website, including all information, content, features, products, and services offered on or through it (collectively, the "Services"). The Services are operated by BellyCozy ("BellyCozy," "we," "us," or "our"), a company organized in the State of Wyoming, United States. Our store is powered by Shopify.

By visiting our site, browsing our products, or placing an order, you agree to be bound by these Terms, including the additional policies referenced here, such as our Refund Policy, Shipping Policy, and Privacy Policy, each of which is incorporated by reference. If you do not agree to these Terms, please do not use the Services.

Please read the Health and Medical Disclaimer in Section 10 carefully. It contains important information about our products and your responsibilities.

2. Eligibility

By using the Services, you represent that you are at least 18 years of age, or the age of majority in your state or place of residence, and that you have the legal capacity to enter into these Terms. If you are using the Services on behalf of another person or entity, you represent that you are authorized to accept these Terms on their behalf. The Services are not directed to children, and we do not knowingly permit anyone under the age of majority to place an order.

3. Changes to These Terms

We may update or modify these Terms at any time, at our sole discretion, for operational, legal, or regulatory reasons, or to reflect changes to the Services. When we do, we will revise the "Last updated" date above. Changes take effect when posted. Your continued use of the Services after any change means you accept the revised Terms. We encourage you to review these Terms periodically.

4. Products, Descriptions, and Availability

We work hard to describe and display our products as accurately as possible. However, we do not warrant that product descriptions, colors, images, measurements, sizing guidance, or other content on the Services are complete, accurate, current, or error free. Colors and finishes may vary slightly depending on your screen settings and lighting, and such variation is normal and is not considered a defect.

All products are offered subject to availability. We reserve the right, at any time and without prior notice, to limit the sale of our products, discontinue any product, or modify product specifications. We do not guarantee that any item will be restocked.

5. Pricing and Payment

All prices are listed in United States Dollars (USD) and are subject to change without notice. We reserve the right to correct any pricing errors, even after an order has been submitted or confirmed.

By providing a payment method, you represent that you are authorized to use it and you authorize us, through our payment processors, to charge the total amount of your order, including any applicable taxes and fees, to that payment method. If your payment cannot be processed, your order may be delayed or canceled.

6. Orders and Order Acceptance

Your submission of an order constitutes an offer to purchase. We reserve the right to accept or decline your order, in whole or in part, at our sole discretion. We may also limit or cancel quantities purchased per person, per household, or per order.

We may refuse or cancel any order for reasons including, but not limited to, suspected fraud, an unauthorized or illegal transaction, a pricing or product error, or a limitation on quantities available. If we cancel an order after you have been charged, we will issue a refund to your original payment method for the canceled items.

7. Shipping and Delivery

We currently ship within the United States only. Shipping is provided free of charge on all orders. Estimated delivery is 4 to 8 business days, typically consisting of 1 to 2 business days of order preparation and 3 to 6 business days of transit. Delivery time frames are estimates, not guarantees, and may be affected by carrier delays or other factors outside our control. For full details, please see our Shipping Policy.

Risk of loss and title for products pass to you upon delivery to the carrier, unless otherwise required by applicable law.

8. Returns and Refunds

We offer a 30-day return window from the date you receive your item. For health and hygiene reasons, returns are accepted only if the item is unworn, unwashed, with all tags attached, and in its original packaging. Approved returns are shipped back to us free of charge using a prepaid return label that we provide after your return request is approved. 9. Accounts

If you create an account with us, you are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and current information and to notify us promptly of any unauthorized use of your account. We reserve the right to suspend or terminate an account that we reasonably believe has violated these Terms or been used for fraudulent or unlawful activity.

10. Health and Medical Disclaimer

Please read this section carefully.

BellyCozy products are comfort and support garments intended for general everyday wear during the postpartum period. They are not medical devices, and they are not intended to diagnose, treat, cure, prevent, or heal any medical condition, including but not limited to diastasis recti, hernias, incontinence, or complications related to childbirth or surgery.

Nothing on the Services, and no communication from us, is intended as medical advice, and it should not be relied upon as a substitute for professional medical guidance. Every body and every recovery is different. Before using a postpartum wrap, and especially if you have had a cesarean section, a complicated delivery, an existing medical condition, or any concern about your recovery, you should consult a qualified healthcare provider, such as your physician or midwife, to determine whether the product is appropriate for you and how to use it.

By purchasing and using our products, you acknowledge that you use them at your own discretion and risk, that individual comfort and experiences vary, and that we make no guarantee of any specific outcome or result. If you experience pain, discomfort, difficulty breathing, or any adverse reaction while wearing a product, discontinue use and consult your healthcare provider.

11. Intellectual Property

All content on the Services, including text, graphics, logos, images, photographs, product designs, and the "BellyCozy" name and branding, is owned by or licensed to us and is protected by applicable intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes in accordance with these Terms.

You may not copy, reproduce, distribute, modify, republish, or create derivative works from any part of the Services without our prior written consent. All rights not expressly granted are reserved.

12. Reviews and User Submissions

If you submit a review, comment, photo, or other content to us or through the Services ("Submissions"), you grant us a non-exclusive, royalty-free, worldwide, perpetual, and transferable license to use, reproduce, display, adapt, and publish that Submission for our business purposes, including marketing, without compensation to you.

You represent that your Submission is your own, that it does not violate the rights of any third party, and that it is not unlawful, misleading, defamatory, or offensive. We may, but are not obligated to, monitor, edit, or remove Submissions at our discretion, and we are not responsible for the content of any Submission.

13. Prohibited Uses

You agree not to use the Services for any unlawful or unauthorized purpose, including to violate any applicable law or regulation, to infringe the rights of others, to transmit malicious code or interfere with the operation of the Services, to submit false or misleading information, to engage in fraudulent transactions, or to attempt to gain unauthorized access to any part of the Services. We reserve the right to terminate your use of the Services for violating any of these prohibitions.

The Services may contain links to third-party websites or services that are not owned or controlled by us. We are not responsible for the content, policies, or practices of any third-party site or service. Your interactions with third parties are solely between you and them, and you should review their terms and policies before engaging with them.

15. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Services and all products are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error free, or that any defects will be corrected. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

16. Limitation of Liability

To the fullest extent permitted by applicable law, in no event will BellyCozy, or its owners, officers, employees, affiliates, agents, or suppliers, be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, loss of data, personal injury, or other intangible losses, arising out of or related to your use of the Services or any product, whether based on warranty, contract, tort, or any other legal theory, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by applicable law, our total aggregate liability for any claim arising out of or related to the Services or any product will not exceed the amount you actually paid to us for the product giving rise to the claim. Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

17. Indemnification

You agree to indemnify, defend, and hold harmless BellyCozy and its owners, officers, employees, affiliates, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your breach of these Terms, your misuse of the Services or any product, or your violation of any law or the rights of a third party.

18. Governing Law

These Terms and any separate agreements whereby we provide you Services are governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law principles.

19. Dispute Resolution and Arbitration

Please read this section carefully, as it affects your legal rights.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Services that cannot first be resolved informally will be resolved by binding arbitration administered on an individual basis, rather than in court, except that either party may bring an individual claim in small claims court if it qualifies. The arbitration will be conducted in accordance with the rules of a recognized arbitration provider, and judgment on the award may be entered in any court having jurisdiction.

To the fullest extent permitted by applicable law, you and BellyCozy agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. You may opt out of this arbitration agreement by sending written notice to us at support@bellycozy.com within 30 days of first accepting these Terms. If any portion of this section is found to be unenforceable, the remainder will remain in effect to the extent permitted by law. This section does not apply where prohibited by applicable law.

20. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in full force and effect.

21. Entire Agreement

These Terms, together with our Refund Policy, Shipping Policy, Privacy Policy, and any other policies or notices posted on the Services, constitute the entire agreement between you and BellyCozy regarding the Services and supersede any prior agreements. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision.
